OREANDA-NEWS. October 01, 2012. The Ministry of Justice of the Russian Federation registered the Administrative Regulations of the Federal Antimonopoly Service (FAS Russia) on control over the field of electric power industry, reported the press-centre of FAS Russia.

On 28th August 2012 came into force the Administrative Regulations on exercising the state function for control over compliance of legal entities and individual entrepreneurs, group of persons and affiliated persons within the boundaries of a single price zone on a wholesale market, with the prohibition for combining electric power transmission and operational dispatch management in the electric power industry with generation and buying-and-selling electric power, including control over compliance with specifics of the functioning of economic entities, operating in the electric power industry mostly to satisfy their own production needs, specified by the law of the Russian Federation (No.416 FAS Order 26th June 2012). The Regulations define the timeframe and the consequences of actions (administrative procedures) for FAS Russia and its regional bodies exercising the state functions. The Regulations also determine the rights and responsibilities of the officials and the persons that are under control for compliance with the prohibition to combine operations in natural monopolies and potentially competitive sectors.

The Administrative Regulations on Control over the Market Council and Organizations of Commercial and Technological Infrastructure (No.418 FAS Order of 26th June 2012) came into effect on 11th September 2012. The Regulations determine the rights and responsibilities of the officials exercising control over the Market Council and organizations of commercial and technological infrastructure of the wholesale markets of electric power (capacity) to ensure compliance with the antimonopoly law of the Russian Federation, as well as the procedures and the framework for exercising the state function.

“Adopting the Administrative Regulations is one of the staging points of improving the work of the antimonopoly authority, which is designed to enhance transparency of exercising state functions by FAS Russia”, pointed out the Head of FAS Department for Control over Electric Power Industry, Vitaly Korolyov.
