Okhrana FUE Violated Antimonopoly Law
OREANDA-NEWS. September 13, 2012. The 9th Arbitration Appeal Court upheld the decision of the Federal Antimonopoly Service (FAS Russia) that the Centre for Operational Management of Extra-Departmental Security Service of the Russian Ministry of Interior and “Okhrana” Federal Unitary Enterprise of the Russia’s Ministry of Interior violated Article 16 of the Federal Law “On Protection of Competition” and issued a determination to impose a fine upon “Okhrana” Federal Unitary Enterprise, reported the press-centre of FAS Russia.
The Centre for Operational Management of Extra-Departmental Security Service of the Russian Ministry of Interior and “Okhrana” Federal Unitary Enterprise violated the law by giving joint instructions for the inter-branch commissions to set requirements to obtain a Competency Certificate for the works for design and assembly of technical security equipment, issued by self-regulated organizations.
“Okhrana” Federal Unitary Enterprise filed a lawsuit to Moscow Arbitration Court to invalidate and abolish the FAS decision and determination to impose the fine. In its turn, Moscow Arbitration Court supported the position of the antimonopoly authority.

Having considered the factual circumstances and case materials, the Appeal Court dismissed the claim of “Okhrana” Federal Unitary Enterprise.
