Moscow Channel FSUE Fined for Infringing Interests of Ship Operator
OREANDA-NEWS. September 12, 2012. The Antimonopoly Service fined “Moscow Channel” Federal State Unitary Enterprise 523,827 Rubles for violating the antimonopoly law, reported the press-centre of FAS Russia.
In 2011, Moscow OFAS Russia received a complaint from “Rechflot” that “Moscow Channel” Federal State Unitary Enterprise was imposing contracts for vehicles passing to piers and that the rates for the services for granting piers to ships for use within the boundaries of the North Riverboat Station had increased.
The Commission of Moscow OFAS Russia examined the case materials and established that “Moscow Channel” infringed the interests of “Rechflot”. OFAS found that the company violated Part 1 Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance).
The Commission of the antimonopoly body established that “Moscow Channel” was forcing the counteragent to pay a fee for its vehicles to pass to the piers of the North Riverboat Station. “Moscow Channel” also violated the pricing procedures established by normative legal acts and created discriminatory conditions for the counteragent in comparison with other economic entities.
Moscow OFAS Russia issued a determination to “Moscow Channel” to eliminate the violations and fined the company 523,827 Rubles.
“Moscow Channel” Federal State Unitary Enterprise could observe the established antimonopoly law but the company abused its market dominance. The discriminatory conditions, created by “Moscow Channel”, resulted in considerable reduction on the number of tickets sold for “Rechflot” shops, which caused financial damages to the ship operator”, pointed out the Head of Moscow OFAS Department for Control over Compliance of Economic Entities with the Antimonopoly Law, Ms. Polina Pashukanis.
