Baikalsk Pulp & Paper Mills Did Not Violate Antimonopoly Law
OREANDA-NEWS. September 07, 2012. FAS found that “Baikalsk Pulp and Paper Mills” OJSC had not violated the antimonopoly law, reported the press-centre of FAS.
The case was initiated upon a petition of “Continental Management” Timber Company” Ltd., which stated that in April – May 2011 “Continental Management” twice approached “Baikalsk Pulp and Paper Mills” OJSC with regard to purchasing sulfate bleached coniferous viscose pulp. However, “Continental Management” Timber Company” Ltd. did not receive answers to any of its commercial offers.
Investigating the case, FAS analyzed the market of sulfate bleached coniferous viscose pulp and established that “Baikalsk Pulp and Paper Mills” OJSC had dominant position on this market within the boundaries of the Russian Federation, with 100% market share.
In January 2012, the “third antimonopoly package” came into force, mitigating the burden of violating Clauses 3 and 5 Part 1 Article 10 of the Federal Law “On Protection of Competition” (imposing contract conditions upon a counteragent; unreasonably refusing or avoiding concluding contracts), Therefore, FAS issued a determination to “Baikalsk Pulp and Paper Mills” OJSC to stop actions that had signs of violating the antimonopoly law.
“Baikalsk Pulp and Paper Mills” OJSC fulfilled the FAS warning so the case was terminated due to absence of the fact of violating the antimonopoly law.
