Arbitration Court: Subsidies in Angarsk Were Granted Unlawfully
OREANDA-NEWS. September 06, 2012. Moscow Arbitration Court upheld the decision of the Federal Antimonopoly Service (FAS Russia) that the Department of Housing & Utility Services and Construction, of Angarsk Town Authority, violated Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
The above organizations violated the law by giving a municipal assignment to the municipal autonomous organization for the works for maintaining burial places for the municipal needs of Angarsk in 2011 and granting subsidies for carrying out the works. The works were carried out by outside economic entities, with who this organization concluded contracting agreements.
The Law of the Russian Federation specifies that local issues, in particular, on maintaining burial places, resolving which means spending funds from the local budget, must comply with the Federal Law “On State (Municipal) Procurement”.
The Department of Housing & Utility Services and Construction, of Angarsk Town Authority disagreed with the FAS decision and filed a lawsuit to Moscow Arbitration Court to invalidate and abolish the decision.
On 30th August 2012, Moscow Arbitration Court dismissed the claim and upheld the FAS decision, supporting the position of the antimonopoly body that the Department had created preferential conditions for the organization in receiving funds from the local budget.
