Court Approved Amicable Agreement of FAS & Roszdravnadzor
OREANDA-NEWS. August 29, 2012. Moscow Arbitration Court approved an amicable agreement between the Federal Antimonopoly Service (FAS Russia) and the Federal Service on Surveillance in Health Care (Roszdravnadzor). The amicable agreement was concluded when Roszdravnadzor was challenging the FAS decision and determination at Court, reported the press-centre of FAS Russia.
In April 2011, FAS found that Roszdravnadzor violated Part 1 Article 15 of the Federal Law “On Protection of Competition” and issued a determination to test whether LK 79090 sterile blood tubing line, manufactured by F.M.S.p.A., Italy, was compatible with INNOVA haemodialisys machine, manufactured by Gambro Dasco S.p.A., Italy.
In course of the judicial proceedings, Moscow Arbitration Court approved the amicable agreement, according to which Roszdravnadzor:
- admitted violating the antimonopoly law;
- executed the determination issued by FAS Russia: introducing changes to the registration certificate, organized technical, toxicological, and medical testing of LK 79090 sterile blood tubing line using INNOVA renal dialyzer.
The testing established compatibility of LK 79090 sterile blood tubing line with INNOVA haemodialisys machine, made by difference producers.
“It is difficult to overestimate significance of the amicable agreement reached between both Services. This precedent proves that consumers can use medical equipment with equivalent consumable materials made by other producers. It will expand the boundaries of the consumable materials market and help suppressing unfair conduct of artificially created monopolies”, stated the Head of FAS Department for Control over Social Sphere and Commerce, Timophei Nizhegorodtsev.
FAS believes that the agreement with Roszdravnadzor, approved by the Court, will facilitate development of competition on the market of consumable materials in Russia.
