Court: Gazprom Dobycha Orenburg Violated Antimonopoly Law
OREANDA-NEWS. August 29, 2012. The 9th Arbitration Appeal Court upheld the judgment of the Court of First Instance. Thus, once again it was confirmed that the Federal Antimonopoly Service (FAS Russia) lawfully issued a decision and a determination on the case against “Gazprom Dobycha Orenburg” Ltd. for violating the antimonopoly law on the market of selling gaseous helium, grade “B”, and the market of the services for transporting helium concentrate, reported the press-centre of FAS Russia.
On 9th November 2011, the FAS Commission found that “Gazprom Dobycha Orenburg” Ltd. violated Clauses 2 and 9 Part 1 Article 10 of the Federal Law “On Protection of Competition”. “Gazprom Dobycha Orenburg” Ltd. violated the law by withdrawing gaseous helium from circulation, which resulted in increasing prices and preventing entry to the market of helium concentrate.
“It is especially important that the Arbitration Appeal Court confirmed legitimacy of the decision and determination issued by the FAS Commission because they concern a market of socially important goods”, Deputy Head of FAS Russia, Andrey Tsyganov, commented the Court ruling.
