OREANDA-NEWS. August 17, 2012. The Federal Arbitration Court of West-Siberian District dismissed the claim “Omsk Airport” OJSC and upheld the determination of the Office of the Federal Antimonopoly Service in the Omsk Region (Omsk OFAS Russia) to fine the company 5,624,460 Rubles for violating the antimonopoly law, reported the press-centre of FAS Russia.

In June 2011, Omsk OFAS Russia found that the holder of natural monopoly had abused its market dominant and violated Part 1 Article 10 of the Federal Law “On Protection of Competition”. OFAS imposed the administrative fine upon “Omsk Airport” OJSC.

In breach of the law, “Omsk Airport” OJSC unreasonably did not allow providers and other economic entities to offer ground handling of business aviation aircrafts in Omsk-Central airport and imposed disadvantageous contract conditions, which resulted or could have resulted in restricting competition on the market of airport services.

“Omsk Airport” OJSC disagreed with the determination issued by the antimonopoly body and filed a lawsuit.

The Courts of three instances, however, upheld the determination of Omsk OFAS Russia to impose fines upon “Omsk Airport” OJSC.

“The Courts of three instances pronounced legitimacy of our determination to fine “Omsk Airport” OJSC. The company has already transferred the money to the federal budget”, commented Deputy Head of Omsk OFAS Russia, Vadim Kabanenko.
