Court Upheld Decision of OFAS on Kaliningradgazifikatsia
OREANDA-NEWS. August 09, 2012. The 13th Arbitration Appeal Court upheld the decision of the Office of the Federal Antimonopoly Service in the Kaliningrad region (Kaliningrad OFAS) regarding “Kaliningradgazifikatsia” OJSC, reported the press-centre of FAS Russia.
In December 2011, the Commission of Kaliningrad OFAS found that “Kaliningradgazifikatsia” OJSC violated Article 10 of the Federal Law “On Protection of Competition” (abusing market dominance) and fined the company 1,236,885 Rubles. The case was initiated upon complaints from residents of the region that the company had unreasonably fixed high prices for installing meters.
“Kaliningradgazifikatsia” OJSC disagreed with the OFAS decision and filed a lawsuit to Kaliningrad Regional Arbitration Court attempting to reverse it, and then appealed to the 13th Arbitration Appeal Court. The Courts, however, supported Kaliningrad OFAS.
“Investigating the case, we established that the company breached pricing procedures, fixing prices for materials used to install gas meters and prices for making-up cost estimates of the works. Thus, “Kaliningradgazifikatsia” OJSC infringed the interests of the general public”, said the Head of Kaliningrad OFAS, Olga Bobrova.
