OREANDA-NEWS.  August 06, 2012. “TGK-2” OJSC will pay 38 million Rubles for cold in residential houses. The company filed a lawsuit to Yaroslavl Regional Arbitration Court but was unable to overturn a multi-million fine, imposed by the antimonopoly body for improper execution of obligations under heating supply contracts, reported the press-centre of FAS Russia. 

Earlier the Office of the Federal Antimonopoly Service in the Yaroslavl Region (Yaroslavl OFAS Russia) found that “TGK-2” OJSC abused dominant position on the market of heating energy transmission (Part 1 Article 10 of the Federal Law “On Protection of Competition”).

The antimonopoly body established that the temperature, generated by “TGK-2” OJSC for the heating needs of apartment houses and social infrastructure facilities, did not meet the parameters of the approved heating supply contracts. For instance, utility services registered the temperature falling below +18C in residential premises and social infrastructure facilities. Yaroslavl OFAS Russia fined the company over 38 million Rubles (Article 14.31 of the Code of the Russian Federation on Administrative Violations) for improperly executing obligations under heating supply contracts with regard to “No.1 Managing Company” OJSC, “Managing Company of Apartment Houses in the Kirov District” OJSC, “Volgar” Homeowners Association, “30, Trrufanova St., Build. 2” Homeowners Association, general educational and pre-school educational institutions, as well as members of general public residing and visiting these economic entities.

“TGK-2” OJSC disagreed with the fine and approached Yaroslavl Regional Arbitration Court. The Court, however, took out side and recognized the fact of infringing the interests of general public and legal persons, whom the company left without proper heating energy in 2010 - 2011 heating season”, pointed out Acting Head of Yaroslavl OFAS Russia, Sergey Balabayev.
