OREANDA-NEWS. July 13, 2012. Representatives of the working group on regulation of entrepreneurship voiced their points of view at a special sitting in the Ministry of Economy held to discuss the only point on the agenda, namely, guillotining inner orders of the Customs Services.

The sitting was taken part in by representatives of the Ministry of Economy, CCI, non-governmental organizations and professional associations (Amcham, AITA, the Association of Foreign Investors, etc). Representatives of the Customs Service were absent from the sitting, having pointed to the concurrent debate of the draft fiscal policy in the parliament. Deputy Minister of Economy Sergei Ciobanu noted that as a result of the preparation to the 6-month report on elimination of non-tariff barriers it was discovered many infringements by the Custom Service.

Namely, inner orders of the Customs Service were found which infringe the legal procedure of standard acts’ coming into effect. Some inner orders are being executed without any publications in Monitorul Oficial. The orders of the Customs Service often contradict each other and create additional barriers for economic agents; some of them are void. According to Inga Ionesi, head of the Main department of trade policies, infringements by the Customs Services were mentioned during DCFTA negotiations in chapter Transparency.

Participants of the working group noted that there are documents in the Customs Service which are published and come into effect without any discussions with businessmen, as well as there are inner orders which are not published at all although their copies are sent to all customs checkpoints and put into practice. Besides, orders are applied to these or those economic agents selectively, which justifies that there are white and black lists of companies in the customs. Businessmen supported the initiative of the Ministry o Economy to have the Customs Service standard acts guillotined.

Besides, they suggested identifying sanctions for violations of law on procedure of approving and putting into effect standard acts. As it was said earlier, the Ministry of Economy drew up a draft resolution of the government providing publication of standard documents of the Customs Service in a special issue of Monitorul Oficial.

The draft resolution was drawn after consultations with a working group of the Governmental Commission on Business Regulation. According to the draft document, the rest standards acts have to become void.
