OREANDA-NEWS. July 12, 2012. The Office of the Federal Antimonopoly Service for the Leningrad Region (Leningrad FAS Russia) fined “Russian Railways” OJSC 44,535,027 Rubles for abusing dominant position, reported the press-centre of FAS Russia.        

In April 2012, the Commission of the antimonopoly body exposed signs of abusing market dominance by “Russian Railways” OJSC (Clause 3 and Clause 9 Part 1 Article 10 of the Federal Law “On Protection of Competition”). The company imposed disadvantageous technical conditions upon “Petrotrans-Primorsk” Ltd. and obligations for developing infrastructure of railway in general use that were not provided for by the existing legislation,. The company also prevented access to the market of using railway infrastructure and the market of transshipment of oil products.

“Russian Railways” OJSC was issued a determination to stop violating the antimonopoly law. The company must forward technical conditions to “Petrotrans-Primorsk” Ltd. without additional encumbrance.

“It’s a small fine for such a big monopolist, but it the sanction provided for by the law for the committed violation. For us, however, executing the determination issues by the antimonopoly body is much more important”, emphasized Deputy Head of OFAS, Gleb Konnov.

In 2010 – 2012, the Central FAS Office investigated 22 cases against “Russian Railways” OJSC upon signs of abusing market dominance (Article 10 of the Federal Law “On Protection of Competition”), and on 12 cases found that “Russian Railways” OJSC violated the antimonopoly law.
