OREANDA-NEWS.  July 10, 2012. The Arbitration Court of St Petersburg and the Leningrad Region confirmed legitimacy of a decision of Leningrad OFAS Russia regarding the Authority of Vsevolozhsk Municipal District that had assigned the functions and the scope of reference of a government agency to its subordinate enterprise – “Ritualnie Uslugi” Municipal Unitary Enterprise, reported the press-centre of FAS Russia.  

The antimonopoly case against the District Authority was initiated upon a petition of a member of Vsevolozhsk Town Council.

The Commission of Leningrad OFAS Russia found that Vsevolozhsk Authority violated Part 3 Article 15 of the Federal Law “On Protection of Competition”. The District Authority was issued a determination to stop violating the antimonopoly law.

“Assigning functions of government agencies of local self-government bodies to economic entities enabled the latter to be the first to obtain unjustified competitive advantages and often monopolize the market. We will undertake resolute measures to prevent such abuses”, emphasized the Head of Leningrad OFAS Russia, Vadim Vladimirov.

The Authority of Vsevolozhsk Municipal District challenged the decision and determination of the antimonopoly body at the Arbitration Court of St Petersburg and the Leningrad Region. The Court dismissed the claim of the District Authority and confirmed legitimacy of the decision and determination issued by Leningrad OFAS Russia.
