Dagestan OFAS Financially Punished Energy Supplying Company
OREANDA-NEWS. June 14, 2012. Dagestan Arbitration Court confirmed legitimacy of a determination issued by the Federal Antimonopoly Service (Dagestan OFAS Russia) to fine “Dagestan Power Supply Company” OJSC (“DESK”) over 34 million Rubles, reported the press-centre of FAS Russia.
On 6th June 2012, Dagestan Arbitration Court dismissed a claim of “Dagestan Power Supply Company” OJSC, challenging the determination of the Antimonopoly Service to fine the company 34,375,010 Rubles.
In 2009, “MRSK North Caucasus” OJSC and “DESK” OJSC initiated and introduced power supply restriction for “Kaspenergosbyt” Ltd. (a power supplying company in Kaspiisk), which infringed the rights and legitimate interests of bona fide consumers. Dagestan OFAS Russia established the fact that “DESK” OJSC had exercised unlawful actions. Dagestan Arbitration Court confirmed the decision of the antimonopoly body.
Dagestan OFAS Russia fined “DESK” OJSC over 34 million Rubles for abusing its dominant position on the market of electric power.
The power company tried to challenge the determination of the antimonopoly body at Dagestan Arbitration Court. However, the Court found the arguments of “DESK” OJSC ungrounded and dismissed the company’s claim.
“Actions of “DESK” OJSC not only were unlawful but also had socially dangerous consequences because the power supplier unreasonably restricted electric power supply to consumers in Kaspiisk”, the Head of Dagestan OFAS Russia, Kurban Kubasaev, commented the Court judgment.
