OREANDA-NEWS. June 08, 2012. Arkhangelsk hosted a workshop on antimonopoly policy, attended by representatives of the Central Office of the Federal Antimonopoly Service (FAS Russia) and its regional offices, judges, representatives of academia.

Deputy Head of FAS, Stats-Secretary Andrey Tsarikovskiy gave a welcoming address to the workshop participants. He emphasized that this was one of the first workshops to discuss enforcement of No.223 Federal Law on procurement by holders of natural monopolies and state corporations. “To achieve effective enforcement of the law several by-laws must be passed”, said Andrey Tsarikovskiy.

The Head of Arkhangelsk OFAS Russia, Konstantin Alyoshin pointed out that “Development of competition is a necessary condition for enhancing economy in the Arkhangelsk region”.

The Head of the Contract Agency of the Arkhangelsk region, Nikolai Pantak emphasized close and productive cooperation with the Antimonopoly Service, although search after truth frequently took place through disputes between the Contract Agency and the Antimonopoly Service.

During the two-day workshop participants discussed practical application of the norms of the so-called “third antimonopoly package” of laws that came into effect in January 2012, No.223 Federal Law on procurement by holders of natural monopolies and state corporations, No.210 Federal Law “On Organization of Providing State and Municipal Services”.

The Head of FAS Department for Control over Housing & Utilities Sector, Construction and Natural Resources, Maksin Kononenko explained some questions emerging when antimonopoly bodies consider complaints about violating competitive bidding procedures and the procedures for concluding contracts.

Deputy Head of FAS Legal Department, Roman Pliev, highlighted some issues of enforcement practice of the so-called “third antimonopoly package” of laws and administrative liability for violating the antimonopoly law.

The workshop participants also discussed problems related to procurement of goods, works and services by holders of natural monopolies and state corporations in view of coming into force No.223 Federal Law “On Procurement of Goods, Works, Services by Certain Types of Legal Entities”.
