OREANDA-NEWS. April 27, 2012. At the Government session it has been adopted the Resolution of the Cabinet of Ukraine developed by the Ministry of Ecology "On amendments to paragraph 1 of the Regulation on the monitoring of land."

The Resolution of the Cabinet Ministers of Ukraine dated October 12, 2011 № 1048 "On Amendments to the Acts of the Cabinet of Ministers of Ukraine on activities of the Ministry of Ecology and Natural Resources and recognition as being lost their validity of some Resolutions of the Cabinet of Ministers of Ukraine", developed by the Ministry of Ecology and Nature Resources, amended the Regulation on the monitoring of land, under which the monitoring of soil on agricultural lands is carried out by the State Committee for Land Resources according to the Provision approved by it.

According to the Land Code of Ukraine and the Law of Ukraine "On Land Protection" the State Committee for Land Resources of Ukraine provides monitoring of land.

But at the same time, according to the Law of Ukraine "On Land Protection" and the Law of Ukraine "On state control over land use and protection" to the powers of the central executive authority on agricultural policy belongs the monitoring of soil of agricultural land.

In addition, according to its Statute the Ministry of Agrarian Policy and Food of Ukraine approves the regulations on monitoring of soil on agricultural lands and monitors these soils.

The above collision between amended by the Resolution of the Cabinet of Ministers of Ukraine dated October 12, 2011 № 1048, and the current legislation has arisen due to the fact that referred draft resolution was developed by the Ministry of Ecology at a time when the President of Ukraine was not yet completely defined functions and powers of the central authorities in the framework of administrative reform.

Thus, the Resolution "On amendments to paragraph 1 of the Regulation on the monitoring of land" brings into line the Resolution of the Cabinet of Ministers of Ukraine dated August 20, 1993 № 661 "On approval of the monitoring of land" to the above legislation.
