OREANDA-NEWS. April 11, 2012. FAS continues to control economic entities for compliance with the legislation on energy saving and on increasing energy efficiency, reported the press-centre of FAS Russia.

Under Sub-Clause 5.3.1.16 of the Regulations on the Federal Antimonopoly Service (FAS Russia), approved by No.331 Decree of the Government of the Russian Federation of 30th June 2004, the Antimonopoly Service controls whether organizations, responsible for installing, replacing, operating metering devices for use of energy resources, comply with the requirements for concluding and executing contracts for installing, replacing, operating these metering devices, the procedures for concluding such contracts as well as the requirements for submitting offers for instrumentation of metering devices for use of energy resources.

In July 2010, FAS instructed its regional bodies to verify whether organizations, responsible for installing, replacing, operating metering devices for use of energy resources, comply with the Federal Law “On Energy Saving and Increasing Energy Efficiency and on Introducing Amendments to Some Legislative Acts of the Russian Federation” in the part of unlawful refusals to conclude contracts regulating conditions for installing, replacing and (or) operating metering devices, as well as obligations to submit proposals for instrumentation of metering devices in residential houses.

Upon inspections, in 2011 regional FAS offices initiated 180 administrative cases upon signs of non-compliance with the law on energy saving, of which:

In Q1 2011, 29 economic entities (23 legal entities and 6 physical persons) were held administratively liable, legal entities and physical persons are fined 2,370,000 Rubles;

In Q2 2011, 117 economic entities (93 legal entities and 24 physical persons) were held administratively liable, legal entities and physical persons are fined 8,540,000 Rubles;

In Q3 2011, 31 economic entities (22 legal entities and 9 physical persons) were held administratively liable, the sum of fines – 2,000,000 Rubles;

In Q4 2011, three legal entities were held administratively liable, the total fines – 250 000 Rubles.

“Energy efficiency and energy saving are some of the main priorities in the government policy”, pointed out the Head of FAS Department for Control over Electric Power Industry, Vitaly Korolyov. Efforts of the antimonopoly authority in this field constitute one of the components of the State Programme “Energy Saving and Increasing Energy Efficiency for the Period up to 2020”.

According to the Head of FAS Department, electric power industry has significant potential. Developments in this field are impossible without objective data on measuring electric energy consumption, which emphasizes importance of control over installment of metering devices.

“The result of our work – quarterly monitoring of the number of violations in this field, shows that the number of violations tends to reduce”, emphasized Mr. Korolyov.

Under Part 9 Article 13 of No.261-FZ Federal Law “On Energy Saving and Increasing Energy Efficiency and on Introducing Amendments to Some Legislative Acts of the Russian Federation” of 23rd November 2009, from 1st July 2010 organizations that supply water, natural gas, heating energy, electric energy or transfer them, and engineering networks directly connected to the networks included in technical equipment of the facilities, that under this Article are subject to instrumentation of metering devices for use of energy resources, must exercise installing, replacing and (or) operating metering devices for use of energy resources, that they supply or transfer. These organizations cannot refuse the persons that applied for concluding contracts regulating conditions for installing, replacing and (or) operating metering devices for use of energy resources, that they supply or transfer.

Under Part 10 Article 13 of No.261-FZ Federal Law “On Energy Saving and Increasing Energy Efficiency and on Introducing Amendments to Some Legislative Acts of the Russian Federation” of 23rd November 2009, organizations, specified in Part 9 Article 13 of the Law on Energy Saving, must submit to the owners of residential houses, specified in Part 5 Article 13 of the Law on Energy Saving, owners of premises in apartment blocks, persons responsible for maintenance of apartment blocks, persons representing interests of the owners, specified in Part 6 Article 13 the Law on Energy Saving, proposals for equipping facilities, specified in Parts 5 and 6 Article 13 the Law on Energy Saving, with metering devices for use of energy resources, that the above organizations supply or transfer.

Clauses 6 and 12 Article 9.16 of the Code of the Russian Federation on Administrative Violations specify administrative liability for failure of those organizations to comply with the legislation on energy saving and increasing energy efficiency.
