OREANDA-NEWS. April 03, 2012. At an All-Russian Research-to-Practice Conference Sergey Puzyrevsky discussed the new antimonopoly law with amendments of the “third antimonopoly package” that came into force in January 2012. He also highlighted the first results of its enforcement, reported the press-centre of FAS Russia.

The audience showed the most interest towards novations to the Federal Law “On Protection of Competition” regarding the criterion for determining monopolistically high prices, standards for classifying anticompetitive agreements and concerted actions, the principle of the “warning” mechanism, and criminal liability for violating the antimonopoly law.

“The new law allows the antimonopoly authority to issue warnings to executive officers of economic entities who publicly announce intended behavior on the market, if such statements may result in violating the antimonopoly law”, pointed out Mr. Puzyrevsky.

The conference participants took a positive view of the changes brought by the “third antimonopoly package”, and also asked numerous questions regarding further prospective development of the antimonopoly law.

Sergey Puzyrevsky said that some aspects, like formalizing the mechanism of establishing and publishing the rules of commercial practice for economic entities with dominant position on the market, need additional discussions.

“I think that adopting the “third antimonopoly package” is an important but not the only element of effective antimonopoly law in Russia. “Implementing” the new norms and robust administration of the law by entrepreneurs, the antimonopoly bodies and judiciaries are no less important”, concluded Mr. Puzyrevsky.
