OREANDA-NEWS. April 02, 2012. The 9th Arbitration Appeal Court confirmed legitimacy of an Order of the Federal Antimonopoly Service (FAS Russia) to include “Railway Departmental Security Service of the Russian Federation” Federal State Enterprise in the Register of Economic Entities on the market of services for shift escort and cargo protection en route on railway transport, reported the press-centre of FAS Russia.  

Under Clause 8 Article 23 of the Federal Law “On Protection of Competition” and a Decree of the Government of the Russian Federation “On approving the Rules for compiling and keeping the Register of Economic Entities that have over 35% share on the market of particular goods or have dominant position on the market of particular goods, if federal laws establish cases for recognizing the dominant position of economic entities for such markets”, and based on the findings of analysis of competitive environment on the market of services for shift escort and cargo protection en route on railway transport, FAS issued the Order to include “Railway Departmental Security Service of the Russian Federation” Federal State Enterprise in the Register of Economic Entities under the position:

- “Services for shift escort and cargo protection en route on railway transport”; the market share > 50%; the geographic boundaries – the Russian Federation.

The FAS Order is aimed at effective control over compliance with the antimonopoly law and preventing “Railway Departmental Security Service” abusing its dominant position on the market of services for shift escort and cargo protection en route on railway transport.
