Dalnevostochny Federal University Violated Law
OREANDA-NEWS. April 02, 2012. The Office of the Federal Antimonopoly Service in the Primorie Region (Primorie OFAS Russia) found that “Dalnevostochny Federal University” State Autonomous Educational Institution of Higher Professional Education violated the antimonopoly law by setting specific requirements to the bidders in the tender documentation that had lead or could have led to restricting competition (in violation of Part 1 Article 17 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.
Earlier the Commission of Primorie OFAS Russia established that “Dalnevostochny Federal University” and the only bidder - “Vintegra Proekty” Ltd. had concluded a contract for developing an “Electronic University” Information System and implementing it at “Dalnevostochny Federal University”. The overall cost of the works was over 647 million Rubles (the initial contract price was 820 million Rubles). “Dalnevostochny Federal University” included the following requirement in the tender documentation: “a bidder must have experience of carrying out works (rendering services) in the field of informational support, information technologies for federal universities (a federal university)”. Setting such a requirement considerably reduced the number of bidders taking part in the tender.
Primorie OFAS Russia intends to file a claim to Primorie Regional Arbitration Court to invalidate the tender and the government contract concluded upon the outcome of the tender.
“At the moment “Dalnevostochny Federal University” has filed a claim to Primorie Regional Arbitration Court to invalidate OFAS decision. In the opinion of Primorie OFAS Russia, such actions of “Dalnevostochny Federal University” are entirely predictable and logical. The Court is the final instance that can draw a line under the situation created”, commented the Head of Primorie OFAS Russia, Sergey Vyalykh.
