Russia Changed Procedures for Privatization of State Property
OREANDA-NEWS. April 02, 2012. No.178 Decree of the Government of the Russian Federation introduced amendments to some acts of the Government of the Russian Federation on privatization of state and municipal property, reported the press-centre of FAS Russia.
The Decree was drafted with participation of FAS Russia and is the first act of the Government of the Russian Federation adopted to enforce the “third antimonopoly service”.
Now the rules for sale of state and municipal property provide for a 10-day moratorium for summarizing sale results and concluding contracts upon the sale outcome, which will enable the antimonopoly bodies to consider complaints about buyers’ actions under Article 18.1 of the Federal Law “On Protection of Competition” – within 5 working days, issuing a mandatory determination should any violations be exposed.
FAS also would like to emphasize, that the “third antimonopoly package” introduced an obligation to publish information regarding privatization of state and municipal property on the official web-site of the Russian Federation regarding tenders after the relevant Government’s Order is issued.
According to the Head of FAS Department for Control over Housing & Utilities Services, Construction and Natural Resources, Maksim Kononenko, placing information on the federal portal for competitive bidding together with prompt complaints administration will enable neutralizing adverse practice of procedural violations in course of selling state and municipal property, and ensure transparency and efficiency of privatization procedures.
