OREANDA-NEWS. March 27, 2012. The Federal Antimonopoly Service (FAS Russia) found that “Spetstekhnika – Gruppa GAZ” (“SGG” Ltd.) and its 25 dealers violated the antimonopoly law by concluding and executing anticompetitive agreements (Clause 2 Part 1.2 Article 11 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia. 

The grounds for the decision: analysis of dealer agreements that prohibited dealers of “SGG” Ltd. to conclude similar dealer agreements with other manufacturers or buy similar products from them (special equipment).

In course of the case investigation, FAS did not find evidence that “vertical” agreements might be allowed. Moreover, FAS Cartel Department established that during a long period the share of “SGG” Ltd. on the market of special equipment was over 70 %.

Such violations of the antimonopoly law are subject to administrative liability. Fines will be imposed upon “SGG” Ltd. and its dealers.

Under Clause 2 Part 1.2 Article 11 of the Federal Law “On Protection of Competition” prohibits “vertical” agreements between economic entities (except “vertical” agreements that are allowed under Article 12 of this Federal Law), if under the agreement the seller requires the buyer not to allow the goods of competitors for sale.
