OREANDA-NEWS. March 21, 2012. The “Federal Grid Company of United Energy System” OJSC (“FGC UES” OJSC) paid a multimillion fine for imposing disadvantageous conditions of a contract for technological connection of “Tyumenenergo” OJSC, reported the press-centre of FAS Russia.

On 12th March 2012, the Federal Arbitration Court of the Moscow District upheld the determination of the Federal Antimonopoly Service (FAS Russia) to impose a turnover fine upon “FGC UES” OJSC – over 130 million Rubles.

On 4 and 5 August 2010, FAS found on two cases that “FGC UES” OJSC violated Clause 3 Part 1 Article 10 of the Federal Law “On Protection of Competition”, establishing the facts of abusing market dominance by the company. Later FAS fined the company over 130 million Rubles.

The company was imposing disadvantageous conditions of a contract for technological connection upon “Tyumenenergo” OJSC that were not directly provided for by normative legal acts.

“FGC UES” OJSC disagreed with the decisions and determinations issued by the Antimonopoly Service and challenged them at Courts.

The Federal Arbitration Court of the Moscow District examined the case as a Cassation instance and supported the position taken by FAS Russia.

In January 2012, FAS received a notification that “FGC UES” OJSC paid a multimillion fine.
