OREANDA-NEWS. March 20, 2012. The Ministry of Justice of Ukraine issued a decree on February 22, 2012 № 296/5 "On approval of the Order of the commission of notarial actions by notaries of Ukraine".

The order took effect on March 7, 2012. Accordingly, the previous instructions on commission of notarial actions by notaries of Ukraine, which was approved by the Ministry of Justice of Ukraine on March 3, 2004 № 20/5, is void.

According to subparagraph 2.2 paragraph 2 of Chapter 2 of Part II of the new order contracts for the alienation or mortgage of immovable and movable property shall be verified by the notary after checking no tax pledge. Paragraph 47 User defined, that contracts for the alienation or mortgage of immovable and movable property (property rights) shall be verified by the notary after checking no tax pledge according to the National Register of liens on movable property.
