OREANDA-NEWS. March 09, 2012. The Office of the Federal Antimonopoly Service in the Leningrad Region (Leningrad OFAS Russia) initiated a case against “Lenenergo” OJSC upon signs of violating pricing procedures (Clause 10 Part 1 Article 10 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.

The Petitioner on the case is “Zaschita” Horticultural Non-Commercial Partnership, located in Novo Toskov village, Vsevolozhsk district, the Leningrad region. According to the Petitioner, in April 2009 between “Zaschita” and “Lenenergo” OJSC concluded a contract for technological connection to electric power networks to supply electric power to residential houses. The costs of services reached several million Rubles.

At the time of concluding the contract, the Guidelines for determining the fee for technological connection to electric power networks were in force. Under the Guidelines, if an applicant for the technological connection is a non-commercial organization, the fee cannot exceed 550 Rubles multiplied by the number of customers of the organization.

According to “Zaschita”, 300 owners of land plots wanted to get connected to the electric power networks. Therefore, the fee to be paid by the Petitioner to the network organization should have been 100 times less charged by “Lenenergo” OJSC.

“The Antimonopoly Service understands the problems of networks organizations, and the need to improve and develop the infrastructure. However, it can be done at the expense of members of the general public – owners of garden plots”, emphasized the Head of Leningrad OFAS Russia, Vadim Vladimirov.
