OREANDA-NEWS. March 06, 2012. “Novosibirskenergosbyt” OJSC (earlier “Sibir Energo” OJSC) reported executing determination of the Office of the Federal Antimonopoly Service in the Novosibirsk Region (Novosibirsk OFAS Russia) to stop violating the antimonopoly law, reported the press-centre of FAS Russia.

On 27th January 2011, the Commission of Novosibirsk OFAS Russia признала “Sibir Energo” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition”. The company abused its dominant market position by imposing disadvantageous contract conditions upon a counteragent, and unreasonably refusing to introduce changes to an additional agreement with “SPAS-Dom” Managing Company” CJSC without technological and economic justification. Unreasonably calculating received electric power on the basis of connected capacity and the number of work hours, the company increased the payment for electric power in common areas in an apartment block.

“Arbitration Courts of three instances confirmed legitimacy of OFAS determination. As a result, on 29th February “Novosibirskenergosbyt” OJSC reported executing the determination of Novosibirsk OFAS Russia: the company drafted an additional agreement that determines the volume of consumption of electric power in common areas according to the standards for consumption of public utility services for power supply”, commented Deputy Head of Novosibirsk OFAS Russia, Alexander Yelchaninov.
