OREANDA-NEWS. February 27, 2012. Stats-Secretary, Deputy Head of FAS Russia Andrey Tsarikovskiy spoke at a conference of Russian Corporate Counsel Association (RCCA) “Practical issues of administering the law on competition in light of adopting the third antimonopoly package”, reported the press-centre of FAS Russia.

Andrey Tsarikovskiy discussed the main objectives towards enforcement of the new antimonopoly law – “the third antimonopoly package”.

Investigating petitions and complaints related to competitive tendering over state-owned property is a new area of the work of the Antimonopoly Service. On 7th January 2012 a new provision of law came into force, which is designed to enhance the quality of antimonopoly control in competitive bidding. “I’m referring to Article 18.1, which applies to bidding for sales of state property. Now the Antimonopoly Service has the right, as for state procurement, to initiate cases on competitive bidding and issue determinations within a short period – seven days”, said Deputy Head of FAS Russia.

The “third antimonopoly law”, according to Andrey Tsarikovskiy, on the one hand simplifies access to state and municipal property, on the other hand – it sets clearer criteria for selecting bidders and the procedures the procedures of competitive bidding. “Earlier there was a common practice, and by the time of finalizing a case investigating and appealing a decision at courts property could actually be in the possession of another economic entity. When the “third antimonopoly law” came into force, tendering is impossible if FAS has issued a determination”, pointed out Deputy Head of FAS Russia.

The audience was especially interested in further development of the antimonopoly law and enforcement of the law “On Procurement for State-Run Companies” (No.223 Federal Law), which was also discussed by Andrey Tsarikovskiy.

The conference was attended by FAS representatives (the Head of the Legal Department, Sergey Pouzyrevskiy, and the Head of Cartel Department, Alexander Kinev), partners from the leading legal firms, PCCA members – the heads of legal departments of companies from various sectors of the economy.
