Ministry of Health Care of Bashkortostan Abolished Unlawful Acts
OREANDA-NEWS. February 16, 2012. The Federal Antimonopoly Service (FAS Russia) received a notification from the Ministry of Health Care of the Republic of Bashkortostan that the Ministry had stopped violating the antimonopoly law by executing the determination of the FAS Commission of 30th November 2011. The Ministry abolished unlawful acts (orders) issued earlier by the Ministry, reported the press-centre of FAS Russia.
On 30th November 2011, the FAS Commission found that the Ministry of Health Care of the Republic of Bashkortostan violated Clauses 2 and 3 Part 1 and Part 3 Article 15 of the Federal Law “On Protection of Competition”. No.100-D Order of 17th February 2006, No.100-D of 18th December 2008 and No.2119-D of 19th January 2011 created conditions that forced wholesale suppliers of medicines to present samples of medicines, brought in the Republic of Bashkortostan, to the “Republican Centre for Quality Control and Certification of Medicines” State Health Care Institution for quality control that is not provided for by the federal law. As a result of such “control”, drugs were assigned regional “quality numbers”, which constituted the grounds for selling the drugs in the Republic.
On 13th January 2012, the Ministry of Health Care of the Republic of Bashkortostan abolished the above orders.
