Court Drew Line in Dispute of Energy Companies & Dagestan OFAS
OREANDA-NEWS. February 16, 2012. The Federal Arbitration Court of the North-Caucasus District pronounced legitimacy of the determination of Dagestan OFAS Russia to fine “Dagestan Energosbytovaya Kompaniya” OJSC (“DESK” OJSC) and “MRSK Severnogo Kavkaza” OJSC 15.7 million Rubles and 20.3 million Rubles (accordingly), reported the press-centre of FAS Russia.
The antimonopoly body fined the companies for unlawfully switching off energy supply to “MIM” Crushed Stone Plant” Ltd. for over six months.
The energy companies filed a lawsuit challenging the decision of Dagestan OFAS Russia.
The Arbitration Court of the Republic of Dagestan, the 16th Arbitration Appeal Court and the Federal Arbitration Court of the North-Caucasus District pronounced legitimacy of the conclusions made by the antimonopoly body.
“Few people know that pursuance of turnover fines, especially such heavy fines, at courts is a big challenge and not always the outcome of such cases is successful for the antimonopoly body. In this case Dagestan OFAS Russia undertook pinpoint legal efforts to suppress abusing market dominance to a full degree and hold the violators administratively liable”, pointed out the Head of Dagestan OFAS Russia, Mr. Kurban Kubasaev.
