Lenenergo Can Be Fined for Failure to Disclose Information
OREANDA-NEWS. February 15, 2012. The Office of the Federal Antimonopoly Service in the Leningrad region (Leningrad OFAS Russia) initiated administrative proceedings against “Lenenergo” OJSC for failure to disclose information about technological connection to electric power networks, reported the press-centre of FAS Russia.
The case was initiated upon numerous complaints of physical persons as well as a petition of “DiKom” Ltd. Citizens drew attention to breaching the deadlines for technological connection of energy-receiving devices to electric power networks of “Lenenergo” OJSC. “DiKom” Ltd. stated that from the date of filing an application (September 2011) for technological connection to electric power networks, the company did not have a possibility to obtain information regarding a stage of the document review.
To gather information concerning the complaints, the antimonopoly body studied information on the official site of the network organization and found that as of 6th February 2012 the following information was not available on www.lenenergo.ru:
- Registration and exercising applications for technological connection to electric power networks;
- The concluded contracts for technological connection to electric power networks, with information about the volume of technological connection, deadlines and payments for each contract;
- Abolished applications for technological connection;
- Completed connections and connected capacity.
According to the Information Disclosure Standards for the participants of wholesale and retail markets of electric power, “Lenenergo” OJSC must disclose and provide access to such data for the general public regardless of the goals for obtaining such information.
In a case of violating the procedures, methods or deadlines for publishing data established by the information Disclosure Standards, a participant of wholesale and retail markets of electric power is punishable by a fine from 200,000 to 500,000 Rubles under Article 9.15 of the Code of the Russian Federation on Administrative Violations.
“Obligations of network companies to disclose important information about its work is legally formalized and is one of the major leverages that society can use to control natural monopolies. FAS Russia and its regional bodies follow the situation closely”, said the Head of Leningrad OFAS Russia, Vadim Vladimirov.
