Ministry of Health Care Eliminated Violation of Antimonopoly Law
OREANDA-NEWS. February 08, 2012. The Federal Antimonopoly Service (FAS Russia) was informed by the Ministry of the Health Care and Social Development about full execution of a FAS determination of 3rd November 2010 on a case on violating the antimonopoly law by the Ministry, reported the press-centre of FAS Russia.
On 3rd November 2010, the FAS Commission recognized that the Ministry of the Health Care and Social Development had failed to make changes to the List of Drugs approved by No.665 Order of the Ministry of the Health Care and Social Development of 18th September 2006, in violation of Clauses 2 and 5 Part 1Article 15of the Federal Law “On Protection of Competition”. In particular: the Ministry of the Health Care and Social Development failed to introduce changes to the List of Medicines, Dispensed on Prescription by Doctors (Paramedics) in Providing Additional Free Medical Assistance to Some Categories of Citizens that Have the Right for Welfare Benefits. It could have restricted competition on the market of medicines. Upon the fact the violation, the FAS Commission issued a determination to the Ministry to eliminate the violation.
As a result of executing the FAS determination, certain formulations of medicines were excluded from the List.
