Court Pronounced Actions of Mukomol & Makfa Unlawful
OREANDA-NEWS. January 30, 2012. The Federal Arbitration Court of the North Caucasus District confirmed legitimacy of a decision and determination of Stavropol OFAS Russia regarding “Mukomol” OJSC and “Makfa” OJSC, reported the press-centre of FAS Russia.
On 22nd December 2010, the Commission found that of Stavropol OFAS Russia “Mukomol” OJSC and “Makfa” OJSC violated Clauses 1 and 6 Part 1 Article 11 of the Federal Law “On Protection of Competition”. In 2010 the companies exercised concerted actions, as a result of which “Mukomol” OJSC supplied wheat to “Makfa” OJSC at a considerably lower prices in comparison with the prices used for other counteragents. Due to fixing preferential tariffs for “Makfa” OJSC, “Mukomol” OJSC accumulated additional expenditures, that the company compensated by increasing prices for other buyers in the Stavropol region and the neighboring provinces.
The companies filed a lawsuit challenging the decision of the antimonopoly body.
Stavropol regional Arbitration Court, the Federal Arbitration Court of the North Caucasus District pronounced legitimacy of the conclusions made by Stavropol OFAS Russia.
“Timely exposing of the violation suppressed unfair actions of the participants of concerted actions and reduce prices for socially important food products”, says the Head of Stavropol OFAS Russia, Sergey Nikitin.
