MOESK Warned 20 Times, Moscow OFAS
OREANDA-NEWS. January 25, 2012. Since the beginning of 2011, Moscow OFAS Russia sent 20 warnings to “MOESK” OJSC to stop actions (omissions) that have signs of violating the antimonopoly law, reported the press-centre of FAS Russia.
OFAS received petitions that “MOESK” OJSC had failed to send draft contracts for technological connections to electric networks, included disadvantageous contract conditions for the petitioners, and failed to adjust the contracts in compliance with the current law.
OFAS verified the facts described in the petitions and when the signs of violations were identified, OFAS sent warnings to “MOESK” OJSC.
“The third antimonopoly package gives new powers to the antimonopoly bodies – to issue warning to stop actions that can be recognized as violations of the antimonopoly law. It is to a monopolist’s benefit to correct the conduct before a case is initiated because the monopolist will be able to escape a turnover fine. Also infringing the interests of a person that filed a complaint will be terminated immediately rather than after a long period of a case investigation and appealing the decision of an antimonopoly body to courts of law”, pointed out the Head of Moscow OFAS Rachik Petrosyan.
In addition Deputy Head of Moscow OFAS, Dmitry Tetoushkin, said: “Changes of the law will help decreasing the burden upon the officers of the antimonopoly body because it will not initiate a case if signs of a violation are voluntarily eliminated. It will allow us to concentrate on investigating more interesting and important cases”.
