OREANDA-NEWS. November 17, 2011. The Federal Antimonopoly Service (FAS Russia) terminated proceedings against “OK RUSAL - Trading House” OJSC due to absence of violations of the antimonopoly law. The case was initiated upon the signs of violating Clauses 3 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

FAS opened the case upon a petition of “Valkom-PM” Ltd. that “OK RUSAL - Trading House” OJSC had abused its market dominance by refusing to arrange shipment of primary aluminum from the nearest plant to the customer and imposing shipment from more distant plants, that increased the costs of delivery.

FAS suspected that such actions contained the signs of violating the antimonopoly law: imposing disadvantageous contract conditions upon the counteragent for aluminum supply or conditions irrelevant to the contract subject, and creating discriminatory conditions.

In course of case investigation, “Valkom-PM” Ltd. petitioned to terminate the antimonopoly case against “OK RUSAL - Trading House” OJSC due to absence of any issues. The FAS Commission granted the petition.

“OK RUSAL - Trading House” OJSC undertook obligations to exercise actions towards protecting competition by developing sales policy with non-discriminatory conditions for consumer access to the goods.
