OREANDA-NEWS. November 17, 2011. The Federal Antimonopoly Service (FAS Russia) received No. 41190-IB/14 Letter from the Ministry of Regional Development, that contained explanations how to apply the law on energy saving, reported the press-centre of FAS Russia.

The explanations were given regarding the requirements for location of devices for measuring energy resources. The Letter specified that “resource-supplying organisations must only install, replace and operate collective (house) devices where facilities (apartment blocks) are connected to district water-supply systems”.

In the FAS opinion, based on understanding of the law on energy saving resource-supplying organisations are obligated to install, replace and operate both collective (house) devices where facilities (apartment blocks) are connected to district water-supply systems as well as individual devices for measuring energy resources.

Also, according to No.67 Decree of the Government of the Russian Federation “On Introducing Amendments to Some Acts of the Government of the Russian Federation in the Issues of Determining the Scope of Reference of Federal Executive Bodies in the Field of Energy Saving and Increasing Energy Efficiency” of 20th February 2010, FAS is responsible for control how the organisations that must install, replace, operate devices for measuring energy resources, comply with the requirements for concluding and executing contracts for installing, replacing and operating the above devices, the procedures for concluding the contracts, as well as the requirements for proposals on equipping devices for measuring energy resources. In accordance with Clause 5.4 of 331 Decree of the Government of the Russian Federation “On Approving the Regulations of the Federal Antimonopoly Service (FAS Russia)” of 30th April 2006, FAS is authorised to generalize and devise recommendations for application and analysis of the law of the Russian Federation in the established field. Therefore, FAS is the body authorised to give explanations regarding installation of measuring devices within its scope of reference.

Based on the above, FAS requested the Ministry of Regional Development to withdraw the Letter. This requirement was fulfilled and on 27th October 2011 the Ministry sent No. 29432-АP/14 Letter to executive bodies about withdrawing No. 41190-IB/14 Letter of 7th December 2010.
