Promtechenergo Violated Antimonopoly Law
OREANDA-NEWS. November 08, 2011. The Office of the Federal Antimonopoly Service in the Novosibirsk Region (Novosibirsk FAS Russia) found that “Promtechenergo” Municipal Unitary Enterprise violated Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
“Promtechenergo” that has dominant position on the market of services for transmitting electric power violated the law by refusing to conclude a contract with an owner of an individual residential house under construction for technological connection to their electric networks.
According to a representative of “Promtechenergo”, the company refused to conclude a contract with the petitioner on the grounds that the plot of the resident is located farther than 300 m from the company’s networks and the law does not specify the procedures for determining contract price for such customers. “Promtechenergo” recommended the petitioner to approach “Raduga” Housing-and-Construction Cooperative, whose electric networks are located closer to the resident’s plot.
The antimonopoly body issued a determination to “Promtechenergo” to stop the violation.
“The Rules for technological connection do not allow a network organization to refuse providing technological connections of the applicant’s energy-receiving device to electric networks. The fee for technological connection must be determined by the authorized body - Novisibirsk Regional Tariff Department. The Department informed the respondent in writing about possibility to set such fee if the applicant’s plot is located farther than 300 m from the company’s networks. By law “Raduga” Housing-and-Construction Cooperative, that owns electric networks, is allowed to connect the customer but is not obligated to do it because it’s not a network organization. At the moment the networks of Raduga” Housing-and-Construction Cooperative are not properly connected to the networks of “Promtechenergo” under a continuous power supply scheme”, commented Deputy Head of Novosibirsk OFAS Russia, Alexander Yelchaninov.
