OREANDA-NEWS. October 26, 2011. The 1st Arbitration Appeal Court confirmed validity of including “Rostelecom” OJSC – in the person of its branch in the Republic of Marii El - in the Register of economic entities with over 35% share on the market of particular goods, reported the press-centre of FAS Russia.

Analysis of the market of services for granting for use line-cable communications facilities to a provider to place communications cables was carried out following the Order of the Federal Antimonopoly Service (FAS Russia) “On FAS Russia’s works schedule for analyzing the state of competition on goods markets in 2009-2010”, as well as the guidelines to the regional offices forwarded by FAS in an official letter.

According to the Order, “Volga-Telecom” OJSC, in the person of its branch in the Republic of Marii El, was included in the Register of economic entities; position: granting for use line-cable communications facilities to place communications cables.

Considering the Order of the Office of the Federal Antimonopoly Service in the Republic of Marii El (Marii El FAS Russia) invalid, “Rostelecom” OJSC – the legal successor of “Volga-Telecom” OJSC filed a lawsuit.

The Arbitration Court of the Republic of Marii El dismissed the claim. The Appeal Court also disagreed with the arguments of the claimants.

“Positive rulings of the courts of two instances confirm the established conditions of turnover of the services of granting for use line-cable communications facilities to place communications cables on the market in Yoshkar-Ola”, commented the Head of Marii El OFAS Russia, Evgeny Kostyushin.

According to Deputy Head of FAS Anatoly Golomolzin, “Including the company in the Register would help guarantee non-discriminatory access to the market of communications services of other providers, which means – developing competition and satisfying subscribers’ needs for in diverse quality services”.
