FAS Found that Drug Quality Control Is Illegal
OREANDA-NEWS. October 10, 2011. The Commission of the Federal Antimonopoly Service (FAS Russia) considered a case against the Ministry of Health Care of the Samara Region, reported the press-centre of FAS Russia.
In January 2011, the Ministry published a letter “On Counterfeit Drugs” in the “Meditsinsky Informatsionny Vestnik” magazine, where the Ministry recommended that the heads of the bodies authorized to manage municipal health care system and the heads of health care facilities and other medical and pharmaceutical organizations in the Samara region:
- should include a condition about monitoring the quality of the drugs, brought in the Samara region under drug supply contracts, in the part of the contract about drug quality requirements;
- when accepting drugs from suppliers, should pay attention whether there drugs undergone monitoring (entry control).
The Commission of the Federal Antimonopoly Service (FAS Russia) found that the Ministry of Health Care of the Samara Region violated Clauses 2 and 3 Part 1 Article 15 of the Federal Law “On Protection of Competition” and issued a determination to withdraw the letter.

On 21 - 30 September 2011, FAS issued a second decision that entry control of drugs quality in the constituent territories of the Russian Federation is unlawful. The first decision found that the Ministry of Health Care of the Sverdlovsk Region violated the antimonopoly law.
The third case in this issue FAS has initiated against the Ministry of Health Care of the Republic of Bashkortostan (the case will be considered on 10th October 2011).
Currently, FAS is collecting evidence to initiate cases on entry control in the Perm region, the republic of Buryatia, Kemerovo, Kirov, Nizhny Novgorod, Pskov, Smolensk and Chelyabinsk region.
