OREANDA-NEWS. September 27, 2011. A Federal Antimonopoly Service Administration in Saint Petersburg decree on stay of action concerning FSUE “Rosmorport” violation of Federal Act “On Competition Protection” dated 26.07.2006 № 135-ФЗ Article 10, Part 1, subsequent to absence of signs of law violation in the enterprise’s actions, is established, reported the press-centre of Rosmorport.

The case was initiated on the basis of MBK JSC and Kontur SPB Ltd. application against FSUE “Rosmorport” actions. Applicants stated that the enterprise obstructed an access to the market of services of waste collection from vessels that pay mandatory environmental dues in the Greater Port Saint Petersburg.

On 19th of September 2011 North-Western District Federal Arbitration Court annulled previous decisions of Arbitration Court of Saint Petersburg and Leningrad Region and 13th Arbitration Court of Appeal on Kontur SPB Ltd. suit against FSUE “Rosmorport”. According to the decree, the conditions of a navigation services contract in reference to FSUE “Rosmorport” duties to provide waste collection from the suitor’s vessels and suitor’s obligations to pay for the environmental dues were declared eligible.
