Kaliningrad OFAS Initiated Cases on Retail Petrol Market
OREANDA-NEWS. September 19, 2011. The Office of the Federal Antimonopoly Service in the Kaliningrad Region (Kaliningrad OFAS Russia) initiated two cases against “Ros&Neft” Ltd., “WestoilBalt” Ltd., “TEK-Keliningrad” Ltd. and “Kaliningradnefteproduct” Ltd. upon the signs of abusing market dominance and exercising concerted actions (violations of Part 1Article 10 and Part 1 Article 11 of the Federal Law “On Protection of Competition”), reported the press-centre of FAS Russia.
“The cases were initiated upon petrol price monitoring in the period from 1st August 2011 to 6th September 2011. Experts of Kaliningrad OFAS Russia have revealed that “Kaliningradnefteproduct” Ltd., “Ros&Neft” Ltd. and “WestoilBalt” Ltd. repeatedly increased retail prices while purchasing prices for motor fuel did not grow. These economic entities as well as “TEK-Keliningrad” Ltd. acted practically simultaneously and in a unified manner: prices were increased within one or two days, which indicates the signs of concerted actions prohibited by the antimonopoly law”, explained the Head of Kaliningrad OFAS Russia, Ms. Olga Bobrova.

Article 11 of No.135-FZ Federal Law “On Protection of Competition” of 26th July 2006 prohibits actions (omissions) of an economic entity with dominant market position, that have resulted or can result in preventing, restricting, eliminating competition and (or) infringing the interests of other persons.
Article 11 of the Federal Law “On Protection of Competition” prohibits agreements between economic entities or concerted actions between economic entities on the market if such agreements or concerted actions lead or can lead to economically, technologically or otherwise unjustified fixing different prices (tariffs) for the same goods, as well as fixing or maintaining prices (tariffs) discounts, mark-ups, surcharges.
