Omsk Airport Abused Market Dominance
OREANDA-NEWS. September 15, 2011. Omsk Regional Arbitration Court upheld the decision of the Office of the Federal Antimonopoly Service in the Omsk Region (Omsk OFAS Russia) regarding “Omsk Airport” OJSC, reported the press-centre of FAS Russia.
The case was initiated upon a petition of “Streamline OPS” CJSC, which concerned that “Omsk Airport” OJSC restricted competition in ground handling of business aircrafts.
In June 2011, Omsk OFAS Russia found that “Omsk Airport” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition”.
The company unreasonably refused to accept applications of economic entities that organise passenger services and services of the aircraft operated by them. It resulted in eliminating competition on the market of airport services.
“Omsk Airport” OJSC disagreed with the decision of the antimonopoly authority and filed a lawsuit.
Omsk Regional Arbitration Court confirmed legitimacy of the conclusions of Omsk OFAS Russia.
“The Court has confirmed our position that “Omsk Airport” OJSC unreasonably refused to accept applications of economic entities that exercises off-scheduled ground handling of passenger aircrafts, although under the current legislation any provider or other economic entity can file an application to the main operator for providing services in the airport”, explained the Head of Omsk OFAS Russia Galina Sitnikova.
