OREANDA-NEWS. September 13, 2011. The Federal Antimonopoly Service (FAS Russia) found that the Centre for Operational Management of Extradepartmental Protection, of the Russian Ministry of Interior, and “Okhrana” Federal State Unitary Enterprise of the Russian Ministry of Interior violated Article 16 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

The case was initiated upon complaints from economic entities of St Petersburg that Extra departmental Protection units required clearance certificates for works on designing and assembling technical security equipment, issued by self-regulated organisations. The requirement was established to execute a joint Order of the Centre for Operational Management of Extradepartmental Protection and “Okhrana” Federal State Unitary Enterprise of the Russian Ministry of Interior.

Investigating the case, the FAS Commission revealed that designing and assembling technical security equipment on facilities commissioned and (or) do not affecting desing characteristics of such facilities can be carried out without certificates issued by self-regulated organisations.

FAS does not possess information about the facts of establishing the requirement for certificates issued by self-regulated organisations in other constituent territories of the Russian Federation.

The FAS Commission concluded that establishing requirements that are not provided for by the law of the Russian Federation resulted in preventing and (or) restricting entry to the market for designing and assembling technical security equipment and creating advantages for of individual economic entities.

Article 16 of the Federal Law “On Protection of Competition” prohibits agreements between federal executive bodies, the authorities of the constituent territories of the Russian Federation, local self-government bodies, other bodies and organisations that exercise the functions of the above bodies and economic entities, or concerted actions or these bodies and organisations, if such agreements or concerted actions lead or can lead to preventing, restricting, eliminating competition.
