FAS Initiated Case against Office of Roszdravnadzor in Bashkortostan
OREANDA-NEWS. September 13, 2011. The Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Health Care of the Republic of Bashkortostan and the Office of Roszdravnadzor [the Federal Services for Supervision of Public Health and Social Development] of the Republic of Bashkortostan upon the signs of antimonopoly violations, reported the press-centre of FAS Russia.
By issuing No.100-D Order of 19th January 2011, the Ministry of Health Care of the Republic of Bashkortostan could have violated Clauses 2 and 3 Part 1 Article 15 of the Federal Law “On Protection of Competition”. According to FAS, the Order can unreasonably prevent activities of economic entities because it sets requirements to economic entities that are not provided for by the law of the Russian Federation and restricts their rights for selling and buying goods.
FAS also identifies the signs of violating Part 3 Article 15 of the Federal Law “On Protection of Competition” by the Ministry of Health Care of the Republic of Bashkortostan issuing No.2119-D Order “On Creating the Centre for Monitoring Medicine Safety in the Republic of Bashkortostan” of 18th December 2008. The Order assigned the functions and the rights of state control and supervision bodies to the “Republican Centre for Medicine Quality Control and Certification”.
FAS also suspects that the Office of Roszdravnadzor of the Republic of Bashkortostan violated Part 3 Article 15 of the Federal Law “On Protection of Competition” by approving the Regulations on the Centre for Monitoring Medicine Safety in the Republic of Bashkortostan, which enables assigning the functions and the rights of state control, and supervision bodies to the “Republican Centre for Medicine Quality Control and Certification”.
The case is scheduled for 10th October 2011.
