Sakhalin OFAS: Rosselkhoznadzor Violated Antimonopoly Law
OREANDA-NEWS. August 31, 2011. The Office of the Federal Antimonopoly Service in the Sakhalin Region (Sakhalin OFAS Russia) found that the Office of Rosselkhoznadzor (the Federal Service for Veterinary and Phyto-Sanitary Control) in the Khabarovsk the Jewish Autonomous Region and the Sakhalin Region violated Clause 2 Part 1 Article 15 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.
Earlier Sakhalin OFAS Russia received petitions from enterpreneurs who asked to verify legitimacy of the actions of the Office of Rosselkhoznadzor that obligated entrepreneurs to make vehicles available for inspection only on the grounds of “ZhelDorEkspeditor-Avto” Ltd., leased out from Kholmsk Commercial Seaport, the entry to which is fee-based. According to the petitioners, such actions of Rosselkhoznadzor were causing them totally unjustified additional expenses.
The Commission of Sakhalin OFAS Russia examined the case materials and concluded that the actions of the Office of Rosselkhoznadzor unreasonably prevented economic activities of cargo carriers.
The antimonopoly body issued a determination to the Office of Rosselkhoznadzor to eliminate the violations and hold the responsible officials administratively liable.

Clause 2 Part 1 Article 15 of the Federal Law “On Protection of Competition” prohibits federal executive bodies to set requirements to economic entities that are not provided for by the law of the Russian Federation.
