Sibirskoe Moloko Paid 2 mn Rubles for Violating Antimonopoly Law
OREANDA-NEWS. August 15, 2011. “Vimm-Bill-Dann” OJSC, in the person of its Novosibirsk branch – “Sibirskoe Moloko”, executed a determination issued by the Novosibirsk Office of the Federal Antimonopoly Service (Novosibirsk OFAS Russia) and paid over two million Rubles for violating the antimonopoly law, reported the press-centre of FAS Russia.
In October 2010, upon investigating the case Novosibirsk OFAS Russia issued a determination to “Sibirskoe Moloko” to adjust the ex-works prices for “Vesyoly Molochnik” milk according to the increase of production costs and prevent unjustified growth of prices.
Under the determination on administrative violation of 2nd December 2010 “Vimm-Bill-Dann” OJSC was fined more than two million Rubles.
“Vimm-Bill-Dann” OJSC disagreed with OFAS conclusions on recognising the fact of the violation and filed a lawsuit to the Arbitration Court in an attempt to invalidate the decision and determination of Novosibirsk OFAS Russia.
As stated by Deputy Head of Novosibirsk OFAS Russia, Mr. Alexander Yelchaninov: “On 28th July 2011, the Cassation Court drew a line in this case. All three Arbitration Court Instances confirmed legitimacy and reasonableness of the decision of Novosibirsk OFAS Russia regarding “Vimm-Bill-Dann” OJSC. An additional inspection of the company showed that “Vimm-Bill-Dann” OJSC executed the determination of Novosibirsk OFAS Russia: from 11th July 2011 “Sibirskoe Moloko” reduced the prices of “Vesyoly Molochnik” milk, 2.5% fat 950 gr. in PurePack, to 24 Rubles 80 kopecks. “Vimm-Bill-Dann” OJSC also executed the determination on the administrative violation – and paid the 2,058,960 Rubles fine in full”.
