Court Confirmed Omsk OFAS Decision on Gas Filling Stations
OREANDA-NEWS. August 15, 2011. The Federal Arbitration Court of the West Siberian District upheld the decision of the Office of the Federal Antimonopoly Service in the Omsk Region (Omsk OFAS Russia) regarding gas filling stations, reported the press-centre of FAS Russia.
In February 2010, Omsk OFAS Russia found that “Gazpromneft-Omsk” OJSC, “SG-Trans” OJSC in the person of its Omsk branch, “SibGaz” Ltd., “SG-2000” NPK” Ltd., “Khimpromsnab” Ltd., “Sibirneftegaz” Ltd. and “Gazstroi” Ltd. violated Part 1 Article 11 of the Federal Law “On Protection of Competition”.
The economic entities were engaged in concerted actions aimed at fixing and maintaining technologically and economically unjustified retail prices for liquified gas used to refuel motor vehicles in 2009 on retail markets in Omsk and Omsk region, which infringed consumer interests.
The companies disagreed with the decision of Omsk OFAS Russia and filed a lawsuit. However, the Courts of three instances confirmed legitimacy of the actions undertaken by the antimonopoly body and dismissed the claim.
“In the near future the Courts will examine whether OFAS lawfully imposed turnover fines upon the companies for violating the antimonopoly law on retail markets of liquefied gas in Omsk and the Omsk region”, said the Head of Omsk OFAS Russia, Sergey Sumenkov.
