OREANDA-NEWS. June 09, 2011. The Office of the Federal Antimonopoly Service in the Sverdlovsk region (Sverdlovsk OFAS Russia) fined “Vodocanal” Municipal Unitary Enterprise 1,304,540.37 Rubles, reported the press-centre of FAS Russia.

On 21st March 2011, Sverdlovsk OFAS Russia found that “Vodocanal” Municipal Unitary Enterprise violated Clause 3 Part 1 Article 10 of the Law “On Protection of Competition”. “Vodocanal” violated the law by imposing disadvantageous conditions of a connection contract upon a counteragent (developer) “- Pravoberezhny” CJSC - by issuing such Technical connection conditions that require construction of engineering networks by efforts and at the expense of “Pravoberezhny” CJSC outside the plot of land that belongs to “Pravoberezhny” CJSC. The conditions that “Pravoberezhny” CJSC must pay a connection fee calculated on the basis of an approved tariff should also be included in the contract.

“It is not allowed to simultaneously demand payment for construction of communal infrastructure facilities by a customer and to charge for connection. “Vodocanal” Municipal Unitary Enterprise has dominant position and is included in the Register of economic entities that have over 35% on the market of particular goods; therefore, prohibitions established by the Law “On Protection of Competition” are fully applicable to it”, commented the Head of Sverdlovsk OFAS Russia, Tatiana Kolotova.
