Courts Confirmed FAS Decision on MRSK North Caucasus & DESK
OREANDA-NEWS. June 01, 2011. The 16th Arbitration Appeal Court pronounced legitimacy of the determination issued by of the Office of the Federal Antimonopoly Service in the Republic of Dagestan (Dagestan FAS Russia) to impose fines – 20,344,160 and 15,718,944 Rubles – upon “MRSK North Caucasus” OJSC and “DESK” OJSC (accordingly), reported the press-centre of FAS Russia.
The case against these companies was initiated upon a petition of “Electrosignal” OJSC.
The Commission of Dagestan FAS Russia found that “MRSK North Caucasus” OJSC and “DESK” OJSC violated Clause 1 Article 10 of the Federal Law “On Protection of Competition”. In October – December 2009 these companies unreasonably terminated supplying electric power to “Electrosignal” OJSC. The antimonopoly body issued a determination to these companies to eliminate the violations.
“MRSK North Caucasus” OJSC and “DESK” OJSC filed a lawsuit challenging the decision and determination of Dagestan FAS Russia. Arbitration Court of the Republic of Dagestan and the Federal Arbitration Court of the North Caucasus District pronounced legitimacy of the conclusions made by the antimonopoly body.
Then Dagestan FAS Russia issued a determination to hold “MRSK North Caucasus” OJSC and “DESK” OJSC administratively liable (imposed an administrative fine) under Article 14.31 of the Code of the Russian Federation on Administrative Violations.
“MRSK North Caucasus” OJSC and “DESK” OJSC also challenged these determinations through a court of law.
Arbitration Court of the Republic of Dagestan and then the 16th Arbitration Appeal Court pronounced legitimacy of the decision of Dagestan FAS Russia fine “MRSK North Caucasus” OJSC and “DESK” OJSC 20,344,160 Rubles (the fine was reduced to 15,718,944 Rubles because the violation was committed for the first time).
“Dagestan FAS Russia lawfully made “MRSK North Caucasus” OJSC and “DESK” OJSC administratively liable and the Court confirmed our conclusions. This ruling passed to our benefit confirms legitimacy of the actions undertaken by the antimonopoly bodies, the goal of which is to protect the interests of consumers of electric power”, said the Head of Dagestan OFAS Russia, Mr. Kurban Kubasaev.
