OREANDA-NEWS. May 26, 2011. The Office of the Federal Antimonopoly Service in the Yaroslavl region (Yaroslavl OFAS Russia) found that “TGK-2” OJSC violated Part 1 Article 10 of the Federal Law “On Protection of Competition”, reported the press-centre of FAS Russia.

The case was initiated upon the findings of investigation of a complaint filed by the Office of Education, of the Yaroslavl Municipal District Authority.

The Commission of Yaroslavl OFAS Russia investigated the complaint and established that ОАО “TGK-2” OJSC unlawfully refused to flush and disinfect the heat supply system of “Svetlyachok” No.27 Daycare Centre” Municipal Children Educational Institution in the Yaroslavl District, which was necessary to prepare the daycare centre for the heating season. “TGK-2” OJSC also breached the timeframe for starting heating supply to this Daycare Centre and “Rodnichyok” No.42 Daycare Centre” in the Yaroslavl District. The delay was approximately a week.

Abusing market dominance is punished by “turnover” fines from 1% to 15% of the company’s income in the preceding year.

“Actions of “TGK-2” OJSC infringed first of all the interests of minors who were freezing. Тhe temperature in the premises of “Svetlyachok” Daycare Centre was extremely low so its work had to be suspended for two days”, commented the case the Head of Yaroslavl OFAS Russia, Ms. Natalia Sibrikova.
