OREANDA-NEWS. May 26, 2011. The Commission of the Federal Antimonopoly Service (OFAS Russia) terminated a case against the Authority of the Kemerovo Region, “SUEK” OJSC and “Kuzbassskaya Tovlivnaya Company” OJSC. The case was initiated upon revealing some signs of concerted actions and subsequently closed due to absence of any violations, reported the press-centre of FAS Russia.

The case was initiated upon the signs of violations of Article 16 of the Federal Law “On Protection of Competition”, which prohibits competition-restricting agreements or concerted actions of federal and local executive bodies and local self-government bodies.

FAS Russia obtained information that in 2009 some of the case participants had conducted negotiations,as a result of which “SUEK” OJSC and “Kuzbassskaya Tovlivnaya Company” OJSC could have set excessive ex-works prices for coal supplied for the needs of housing and utilities sector of the Kemerovo region.

In course of the case investigation, FAS was not able to confirm information about concerted actions of the regional authority and coal companies.

At the same time, “SUEK” OJSC and “Kuzbassskaya Tovlivnaya Company” OJSC remain participants in another antimonopoly case initiated upon the signs of violating Part 1 Article 16 of the Federal Law “On Protection of Competition” - competition restricting agreements or concerted actions on the coal market. Other participants in this case are: “Russky Ugol” OJSC, “Krasnoyarskkraiugol” OJSC, “Sotsugol” State-Run Enterprise, “Kuzbassazrezugol” Coal Company” OJSC, “Rostopprom” OJSC and “Far Eastern Generating Company” OJSC. The case is scheduled for the end of June 2011.
